LegalThe Closed List
Terms of Use
Effective date:
These Terms of Use ("Terms") are an agreement between you and Maude House LLC, a Florida limited liability company ("Maude House," "we," "us" or "our"), and govern your use of theclosedlist.com, every edition of The Closed List, and any domain that forwards to them (together, the "Site"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
Please read Section 13 carefully. It requires most disputes to be resolved through individual arbitration, not a class action or jury trial.
1. What The Closed List is
The Closed List is an editorial publication that organizes and presents information about real estate teams, based mainly on RealTrends Verified closed-sales data and other public sources. It is published by Maude House, a marketing agency.
The Closed List is not a real estate brokerage, a licensed real estate agent, a lender, an appraiser or a law firm. We do not represent buyers or sellers, and we do not receive referral fees, commissions or payments of any kind from any team for its ranking or placement.
2. Not advice
Everything on the Site is for general information only. Nothing on the Site is real estate, legal, financial, tax or investment advice, and nothing is a recommendation to hire, or not hire, any particular person or team. Choosing a real estate professional is your decision. Before you hire anyone, do your own research, interview more than one professional, check their license with the Florida Department of Business and Professional Regulation (or your state's licensing agency), and get professional advice that fits your situation.
3. Rankings, data and opinions
Sources. Rankings and figures come mainly from RealTrends Verified, from Google Business Profiles and from information that teams publish about themselves. We cite the source and the date we checked it. We don't control these sources, and they may contain errors, omissions or delays.
Opinion and editorial judgment. How we organize, categorize, describe and present information (including the categories we choose, the order of lists, the "How to Choose" guide and any descriptive language) reflects our editorial judgment and opinion. A ranking in one category is not a statement that a team is better or worse overall.
Team-reported information. Some figures, such as list-to-sale ratios, days on market or lifetime sales, are reported by the teams themselves. We label these as team-reported and have not independently verified them.
No guarantee. We work hard to be accurate, but we don't guarantee that any information on the Site is complete, current or error-free. Rankings and data can change at any time. A team's past results do not predict future results.
Corrections. If you believe something on the Site is inaccurate, email tally@theclosedlist.com with the details and a source. We review every request in good faith and log changes publicly. We decide, in our sole discretion, whether and how to change, update or remove any content.
4. Third-party names and trademarks
Team names, brokerage names, RealTrends, Google and other names on the Site are trademarks or names of their respective owners. We use them only to identify the teams and sources we write about. Their appearance on the Site does not mean they sponsor, endorse or are affiliated with The Closed List, and The Closed List is not affiliated with RealTrends or HW Media.
5. Client relationships
Maude House provides marketing services to some of the teams that appear on the Site. We disclose those relationships on our Disclosures page and on the relevant pages. These teams have no control over our method, data or rankings, and they are held to the same rules as every other team.

Any other use of our name or logo needs our written permission.

The Site links to websites we don't control. We aren't responsible for their content, accuracy, policies or practices. Visiting them is at your own risk.
10. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT ALLOWED BY LAW, MAUDE HOUSE DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
11. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, MAUDE HOUSE AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE, THE CONTENT OR THESE TERMS, INCLUDING ANY DECISION TO HIRE OR NOT HIRE ANY REAL ESTATE PROFESSIONAL, EVEN IF WE WERE TOLD THESE DAMAGES WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE, THE CONTENT OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some places don't allow certain limits on liability, so some of these limits may not apply to you.
12. Indemnity
You agree to defend, indemnify and hold harmless Maude House and its owners, members, employees, contractors and agents from any claims, losses, damages and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or the Content, or your violation of these Terms or anyone's rights.
13. Disputes: informal resolution, arbitration and class action waiver
Talk to us first. Before filing any claim, you agree to email tally@theclosedlist.com with a description of the problem and give us 30 days to try to resolve it informally.
Arbitration. If we can't resolve it, you and Maude House agree that any dispute arising from or relating to the Site, the Content or these Terms will be resolved by final, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or its Commercial Arbitration Rules, if the claim is brought by a business), rather than in court. The arbitration will take place in Walton County, Florida, or by video conference, and the arbitrator may award the same individual relief a court could.
Exceptions. Either party may bring an individual claim in small claims court, and either party may go to court to stop infringement or misuse of intellectual property.
Class action waiver. You and Maude House each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine claims or preside over any class proceeding.
Jury trial waiver. If a dispute goes to court for any reason, you and Maude House each waive the right to a jury trial.
Time limit. Any claim must be brought within one year after it arises, or it is permanently barred, to the extent the law allows.
14. Governing law and venue
These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. For any matter not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Walton County, Florida.
15. Copyright complaints
We respect intellectual property rights. If you believe something on the Site infringes your copyright, send a notice to our designated agent with: your contact information; a description of the copyrighted work; the URL of the material; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature.

16. Changes and termination
We may change, suspend or discontinue any part of the Site at any time. We may update these Terms by posting a new version and changing the effective date. Using the Site after an update means you accept the new Terms. We may block anyone who violates these Terms.
17. General
These Terms, together with our Privacy Policy, are the entire agreement between you and Maude House about the Site. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part is not a waiver. You may not transfer your rights under these Terms; we may transfer ours. Section headings are for convenience only.
